Every year, as November rolls around, my NRI clients start getting anxious. The calendar is ticking, and they’re wondering if there’s anything they should be doing before the financial year ends. I’ve been through this cycle dozens of times now, and I’ve learned that there are three specific moves that matter most for NRI taxation in India.

These aren’t complicated strategies. They’re practical, straightforward, and they save money when done right. Let me walk you through them.

Move 1: Lock In Your Residential Status Before Year-End

This one catches people off guard more often than you’d think. Your residential status for a financial year isn’t determined on January 1st — it’s determined by where you are and how long you’ve been there during that fiscal year.

If you’re an NRI trying to stay an NRI for tax purposes, or an Indian resident planning to become an NRI, the final months of the year matter significantly. The rules are clear under the Income Tax Act: you’re a resident in India if you’ve spent 182 days or more in India during the financial year, or 60 days in the current year and 365 days in the preceding four years (for most people).

I advise clients to audit their travel dates by November itself. If you’re close to the 182-day threshold and you don’t want to be a resident, you need to plan your travel accordingly. If you want to become a resident for tax purposes, you need to ensure your days add up correctly.

Waiting until March to figure this out is too late. Your residential status drives everything else — tax rates, filing requirements, FEMA regulations. Get this right in December.

Move 2: Optimize Your Global Income Declaration

Most NRI clients I work with have income from multiple jurisdictions — salary from abroad, rental income from India, maybe some freelance income or investment returns. By December, you need clarity on what you’re declaring and where.

Here’s what I do for every client: we review the previous 11 months and project the full year’s income across all sources and all countries. Then we map out which income is taxable in India, which gets foreign tax credits, and which might be covered under tax treaties.

The reason this matters in December is simple — if there are gaps or issues, you still have time to correct them before the financial year ends. I’ve seen clients discover in February that they’ve been filing incorrectly all year, and by then, there’s limited recourse.

Additionally, if you have rental income from Indian property or capital gains from Indian investments, December is the right time to finalize how much income you’re reporting and whether you need to make any adjustments or corrections before the year closes.

Move 3: Plan Your India Business Structure and Compliance

If you’re an NRI with an active business interest in India — whether it’s a partnership, a directorship, or a proprietorship — December is when you need to confirm your compliance calendar for the coming year.

This includes:

  • Whether you need to file GST returns (and which frequency)
  • Whether your business triggers TDS obligations
  • Whether you’re meeting director responsibilities and Board meeting requirements
  • Whether you’re due for an audit under the Audit Threshold rules

I work through this with clients because non-compliance spirals fast. Missing a GST filing creates cascading penalties. Missing an audit when you’re required creates serious scrutiny. Missing director compliance creates personal liability.

By December, I ensure every NRI client knows exactly what they’re supposed to do between January and December of the next year. We build a compliance calendar together. It’s preventive work, but it saves far more than it costs.

Why December Matters

These three moves matter because December is the last month of the financial year in India. It’s your final window to make year-end decisions that affect taxation and compliance. Waiting until March or April — when returns are due — is playing catch-up.

If you’re an NRI and you haven’t reviewed these three areas yet this year, now’s the time. The decisions you make in the next few weeks will shape your tax position for the entire financial year.
